As reported earlier, on August 10, 2005, we filed in Kent County Circuit Court a Freedom of Information Act complaint against the City of Grand Rapids to obtain the release of documents related to the value of the Boardwalk project. One document in particular is a letter the City has from the Boardwalk developers that they had invested only $20 million into the project instead of the $30-35 million they had claimed elsewhere.
The City Attorney's office was obligated to answer our complaint by August 31st. They failed to do so. We don't know why. What that means is that the City defaulted and may now let us obtain a judgment in our favor against it. Whether this would do us any good if the City simply refuses to acknowledge the decision of the court, we don't know yet. We do know that the bad faith of the City Attorney's office in withholding public records from citizens continues on.
